Welcome to The Indigo Auction (“we”, “our”, “us”). These Terms & Conditions govern your use of our website www.theindigoauction.com and the purchase of products through it. By accessing or using our website, you agree to be bound by these Terms. If you do not agree, please do not use the site.

2. Use of Our Website

• You agree not to misuse this site or attempt to interfere with its proper operation.

• All content (images, text, graphics) is owned by or licensed to us and may not be reproduced without permission.

• We reserve the right to suspend or terminate access to the site if you breach these Terms.

3. Orders & Contract

• Your order is an offer to purchase products. We will confirm acceptance by email once payment has been received.

• We reserve the right to refuse or cancel any order for reasons including stock availability, errors in pricing or product description, or suspected fraud.

• Prices are shown in GBP and include/exclude VAT where indicated.

4. Payment

• We accept payment by Visa, Mastercard, PayPal, and Klarna (Buy Now, Pay Later options).

• All payments must clear before dispatch.

• When using alternative payment providers (Klarna, Clearpay, Paypal etc) you enter into a separate agreement with these 3rd Parties. Additional terms apply (Please ensure you read these before using their services)

5. Products

• We make every effort to display products accurately; however, images are for illustrative purposes only.

• As many of our items are collectible, minor variations in packaging or external condition may occur and do not affect product contents.

• We source our products from reputable vendors based in Japan and whilst they provide every assurance these products are authentic, there is no guarantee that counterfeit products may make their way through.

• In the case of counterfeit products being identified, we will work with you to ensure we resolve the situation.

• Pre-orders are subject to supplier allocations and estimated release dates, which we cannot guarantee.

6. Delivery

• Products will be dispatched in accordance with our Shipping Policy.

• Orders will be shipped via Royal Mail/Parcelforce.

• Risk of loss or damage passes to you upon delivery, whilst we will look to assist with any shipping issues we cannot be held responsible for losses caused by Royal Mail/Parcelforce.

• If there are unforseen situations where delivery of goods are delayed, we will inform you at the earliest convienience.

7. Cancellations & Returns

• Your statutory rights under UK consumer law apply.

• Cancellations before shipping will incur a cancellation fee of 3% of the order value or £3 (Whichever comes first)

• Pre-orders will also be subject to a cancellation fee, payment will be held until shipping of the pre-order item.

• Due to the sealed nature of products we are unable to provide refunds once an item has shipped unless there is damage or issues caused by our own negligence. 

8. Liability

• Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

• Subject to the above, we are not liable for indirect or consequential losses, or for delays outside our control.

9. Intellectual Property

• Pokémon® and all related names are trademarks of Nintendo, Creatures, and GAME FREAK. We are not affiliated with or endorsed by these companies.

• All content on this site is our property and protected under copyright law.

10. Governing Law

• These Terms are governed by the laws of England and Wales.

• Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We may update these Terms from time to time. The latest version will always be available on this page, and continued use of our website constitutes acceptance of any updates.
